Welcome to IndyCreator.com ("we", "our", "us"). By applying to or using our website and services, you agree to comply with and be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Eligibility

Our service is open to individuals who are at least 18 years old. By submitting an application or using the platform, you confirm you meet this age requirement and agree to these Terms. Submission of an application does not guarantee acceptance.

2. Use of the Service

You agree to use IndyCreator.com for lawful purposes only and not to:

• Violate any laws or regulations;
• Impersonate others or post false information;
• Upload harmful, offensive, or inappropriate content;
• Interfere with the operation or security of the service;
• Share or resell access to unlocked creator profiles;
• Attempt to bypass the profile unlock system.

3. Creator Profiles and Network

Our platform operates on a pay-to-unlock model for creator profiles. By using the service, you acknowledge and agree that:

• Creator profiles require a one-time payment to unlock ($35 per creator);
• Unlocked profiles remain accessible as long as your account is active;
• Profile unlocks are non-transferable and non-refundable;
• We reserve the right to modify unlock pricing with notice;
• Creators may update or deactivate their profiles at any time.

4. User Content

You are solely responsible for any content you submit or share on the platform. You grant us a license to use your content as described in Section 5 below.

5. Intellectual Property

All content on IndyCreator.com is owned by us or our licensors. You retain ownership of any content you submit, but you grant us a worldwide, royalty-free license to use, display, and distribute it to provide and promote the service.

6. Payments and Refunds

All payments are processed securely through Stripe. By making a payment, you agree that:

• All profile unlock purchases are final and non-refundable;
• You are authorized to use the payment method provided;
• You will not dispute charges for valid profile unlocks;
• We may share necessary transaction data with Stripe;
• Pricing is subject to change with notice.

7. Termination

We may suspend or terminate your access at our discretion, including for violations of these Terms. In case of termination:

• Previously unlocked profiles may become inaccessible;
• No refunds will be issued for past unlocks;
• You remain bound by relevant terms (e.g., confidentiality).

9. Disclaimers and Limitation of Liability

The service is provided "as is" without warranties of any kind. We are not liable for damages arising from your use of the service. This includes but is not limited to:

• Accuracy of creator profiles or information;
• Availability of creators or their services;
• Outcomes of creator collaborations;
• Technical issues affecting profile access.

10. Dispute Resolution

Any disputes arising from these Terms or your use of the service shall be governed by Indiana state law and resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

11. Changes to Terms

We may update these Terms from time to time. Continued use of the service after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the state of Indiana, without regard to its conflict of law principles.
